Acceptable Use Policy

This Acceptable Use Policy (“AUP”) applies to your use of any service provided by Zinam Consulting Inc., operating as Buzzmax.ca (“Buzzmax”), including AI Answering Service, Business Phone / Hosted PBX / Cloud PBX, Call Centre Solutions, Internet Service, and any other service we offer (collectively, the “Services”). This AUP is part of, and incorporated into, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms of Service.

1. General Prohibited Uses

You may not use the Services to:

• violate any applicable law or regulation, or the rights of any third party, including intellectual property, privacy, or publicity rights;
• transmit, store, or make available content that is abusive, harassing, threatening, defamatory, obscene, or otherwise unlawful;
• engage in fraud, phishing, identity theft, or any deceptive or misleading practice; or
• resell, sublicense, or provide access to the Services to a third party except as expressly permitted in your service order.

2. Telephone, VoIP, and Call Centre Use

Because many Buzzmax Services involve telephone calling, automated answering, and outbound dialing, you agree not to:

• alter, spoof, or misrepresent caller identification information in a manner prohibited by the Canadian Radio-television and Telecommunications Commission (CRTC) or the Radiocommunication Act;
• place telemarketing calls to a number registered on Canada’s National Do Not Call List, or otherwise place calls in violation of the CRTC’s Unsolicited Telecommunications Rules, unless an applicable exemption applies to your organization or call;
• use the Services to place illegal automated (robocall) calls, or to make excessive or abusive numbers of outbound calls that amount to harassment;
• use the Services in a manner that violates Canada’s Anti-Spam Legislation (CASL), including sending commercial electronic messages without the required consent and identification information; or
• record calls using Buzzmax’s call recording features without providing notice where required by applicable law. Ontario and federal law generally permit recording where at least one party to the call consents; you are responsible for any additional notice or consent requirements that apply to your business or industry.

3. Network and Security

You agree not to:

• attempt to gain unauthorized access to any Buzzmax system, account, or network, or to any other customer’s account or data;
• introduce viruses, malware, or other harmful code into the Services;
• interfere with or disrupt the integrity or performance of the Services or the networks connected to them, including through denial-of-service attacks or excessive automated querying; or
• use the Services in a way that places unreasonable strain on shared network resources to the detriment of other customers, taking into account normal usage for your plan.

4. Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account, including activity by employees, contractors, or agents you authorize to use the Services. Notify Buzzmax immediately at sales@buzzmax.ca if you become aware of unauthorized use of your account.

5. Internet Service Use

For customers of Buzzmax Internet Service, in addition to the general prohibitions above, you agree not to use the connection to operate unauthorized servers that materially degrade network performance for other customers, or in a manner inconsistent with the fair use expectations of a residential or business-grade connection as described in your service order.

6. Reporting Abuse

To report suspected abuse of the Services, contact sales@buzzmax.ca. Buzzmax investigates reports of misuse and reserves the right to request additional information from the account holder to complete an investigation.

7. Enforcement

Buzzmax may investigate suspected violations of this AUP and may, at its discretion, suspend or terminate access to the Services, remove or disable content, or take other action it considers appropriate, with notice where practical. Repeated or serious violations may result in immediate termination in accordance with our Terms of Service. Buzzmax may also disclose account information where required to respond to a complaint from a regulatory body, government authority, or licensed telecommunications carrier concerning your use of the Services.

8. Changes to This Policy

Buzzmax may update this AUP from time to time by posting a revised version on our website with an updated “last updated” date. Your continued use of the Services after a revision takes effect constitutes your acceptance of the revised AUP.
